Terms and Conditions

1. Definitions

  • “Company,” “we,” “our,” or “us” refers to Precision Forklift Training.
  • Client” refers to the company or individual booking training services.
  • Training” refers to any forklift, plant, MHE, or related instruction delivered onsite or at an agreed location.
  • Instructor” refers to a qualified RTITB-accredited trainer or examiner.
  • Delegate” refers to any person attending training.

2. Accreditation

All relevant courses are delivered in accordance with standards set by RTITB where applicable. Accreditation is subject to successful completion of required practical and theoretical assessments. Certificates are only issued where delegates meet the required RTITB standard.

3. Delivery of Training

Training will be delivered at the location agreed upon at the time of booking. The Instructor reserves the right to stop training if the environment is deemed unsafe or if the equipment provided is not fit for purpose.

4. Facilities and Equipment

The Client is responsible for providing:

  • A suitable area for practical training and testing.
  • Equipment in good working order with a valid Report of Thorough Examination (LOLER).
  • A quiet area for theoretical training and testing.
  • All necessary PPE for delegates.

5. Booking and Confirmation

Bookings are only confirmed once the Company has issued a confirmation email. By confirming a booking, the Client agrees to these Terms and Conditions.

6. Prices and Payment

  • All prices are quoted exclusive of VAT unless otherwise stated.
  • Payment terms are [e.g., 14 days from invoice date].
  • Late payments may incur statutory interest and recovery costs under the Late Payment of Commercial Debts legislation.
  • Certificates may be withheld until payment is received in full.

7. Cancellations and Rescheduling

By the Client:

  • More than 7 days’ notice: no charge or partial charge at Company discretion.
  • Less than 7 days’ notice: up to 50% charge.
  • Less than 48 hours’ notice or non-attendance: full fee payable.

By the Client:

The Company reserves the right to reschedule training due to illness, adverse weather, instructor unavailability, or circumstances beyond reasonable control. Liability shall be limited to refunding fees paid for the affected training session.

8. Certification

RTITB certificates and/or operator cards will only be issued where:

  • The delegate attends the full course duration;
  • Required assessments are completed, and
  • The instructor determines the required standard has been achieved.

The Company cannot guarantee a pass.

9. Health and Safety

Training is delivered in accordance with applicable UK health and safety legislation, including:

  • Health and Safety Executive guidance;
  • PUWER;
  • LOLER; and
  • Relevant Approved Codes of Practice.

The Client retains responsibility for site safety and operational control at all times.

10. Liability

The Company shall not be liable for any loss, damage, or injury caused by the Client’s equipment or premises. Our total liability shall not exceed the total price paid for the specific training course.

11. Insurance

The Company maintains appropriate public liability and employer’s liability insurance. The Client remains responsible for insurance relating to its own premises, staff, and equipment.

12. Intellectual Property

Training materials, documents, presentations, and course content remain the intellectual property of the Company and may not be copied or distributed without written permission.

13. Termination

We reserve the right to terminate training immediately if a delegate is under the influence of alcohol/drugs, acts aggressively, or fails to follow safety instructions. No refund will be given.

14. Force Majeure

The Company shall not be liable for delays or failure to perform obligations caused by events outside reasonable control, including: severe weather; industrial disputes; transport disruption; power failure; or government restrictions.

15. Amendments

We reserve the right to update these Terms and Conditions at any time. The version in effect at the time of booking shall apply.

16. Governing Law

These terms are governed by the laws of Scotland. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
